These Terms of Use (“Terms”) apply to your use of inyenda.com (the “Site”), operated by Yenda Inc. (“Yenda”, “we”, “us”). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. About the Site

The Site gives general information about Yenda and our human data services. Nothing on the Site is an offer to provide services. Any services we provide are governed by a separate written agreement, such as a master services agreement, statement of work or NDA. If that agreement conflicts with these Terms, the agreement wins.

2. Using the Site

You may use the Site for lawful purposes only. You agree not to:

use the Site in a way that breaks any law or regulation
try to gain unauthorised access to the Site, its servers or any connected systems
interfere with the Site's security or operation, including by introducing malware or overloading it
scrape, copy or harvest content or data from the Site by automated means without our written permission
use the Site to send spam or unsolicited communications
pretend to be someone else, or misrepresent your connection with any person or company

3. Information you send us

When you contact us or submit the contact form, you confirm that the information you provide is accurate, and that you have the right to share any files you upload, such as data samples or guidelines.

Please don't send confidential or sensitive data before we've agreed terms for handling it. We're happy to sign an NDA first. Until an NDA or other agreement is in place, we'll treat what you send with reasonable care, but these Terms don't create a confidentiality obligation.

4. Intellectual property

The Site and its content, including text, graphics, data visuals, logos and design, are owned by Yenda or our licensors and are protected by intellectual property laws. You may view and share Site pages for your own information. You may not copy, modify, republish or use our content commercially without our written permission.

Client names, logos and trademarks shown on the Site belong to their owners and are used with permission. Their appearance doesn't mean those clients endorse anything beyond what is stated.

5. Case studies, statistics and insights

Case studies, figures (such as quality rates, volumes and launch times) and Insights articles describe past projects and our general experience. They're for information only. Results depend on each project's scope, data and requirements, and past results don't guarantee future outcomes. Insights articles aren't professional advice for your specific situation.

6. Links to other websites

The Site may link to third-party websites. We don't control them and aren't responsible for their content, policies or practices.

7. Disclaimer

The Site is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, about the Site, including that it will be accurate, complete, uninterrupted or free of errors or harmful components.

8. Limitation of liability

To the fullest extent the law allows, Yenda won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of, or inability to use, the Site. Our total liability for any claim relating to the Site is limited to US$100.

Nothing in these Terms limits liability that can't be limited by law.

9. Indemnity

You agree to indemnify Yenda against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

10. Changes to the Site and these Terms

We may change, suspend or remove any part of the Site at any time. We may also update these Terms. The new version applies from the date it's posted here, and continuing to use the Site means you accept it.

11. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. Any dispute relating to the Site will be handled by the state or federal courts located in Henry County, Georgia, unless the law where you live gives you the right to bring a claim elsewhere.

12. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right doesn't mean we've waived it. These Terms, together with our Privacy Policy, are the whole agreement between you and Yenda about your use of the Site.
