Privacy Policy
This Privacy Policy explains how Yenda Inc. (“Yenda”, “we”, “us”) collects, uses and protects personal information when you visit inyenda.com (the “Site”) or contact us through it.
This policy covers the Site only. Personal information we process when delivering services to clients is governed by our agreements with those clients. Information from people applying to work with Yenda is covered by a separate notice on our recruitment platform.
1. Who we are
Yenda Inc. is a company registered in Georgia, United States, with its address at Broadmoor Way, McDonough, GA 30253, United States. For any privacy question or request, contact us at hello@inyenda.com.
2. Information we collect
Information you give us. When you complete our contact form or email us, we collect:
- your name, work email address and company
- details of your project: the services you need, expected volume, target start date and a description of the task
- any files you choose to upload, such as data samples or guidelines
- anything else you include in your messages to us
Please don't include sensitive personal information (for example, health or financial data about individuals) in samples you send before we've agreed how that data will be handled. We're happy to sign an NDA before you share project data.
Information collected automatically. When you visit the Site, we and our analytics providers collect technical information, such as your IP address, browser and device type, approximate location (country or city), the pages you visit, how long you stay and how you arrived at the Site. Some of this is collected through cookies (see section 9).
We don't knowingly collect information from children, and the Site is not intended for anyone under 16.
3. How we use your information
We use personal information to:
- respond to your enquiry and prepare the delivery plan, estimate or other information you ask for
- communicate with you about our services, including follow-up on your enquiry
- run, maintain, secure and improve the Site
- understand how visitors use the Site, using aggregated analytics
- comply with legal obligations and protect our rights
We don't sell your personal information, and we don't use it for automated decision-making that has legal or similarly significant effects on you.
4. Legal bases (EU and UK visitors)
If you're in the European Economic Area or the United Kingdom, we rely on these legal bases:
- Legitimate interests: responding to business enquiries, running and securing the Site, and understanding how it's used
- Steps before a contract: where you ask us to prepare a proposal or delivery plan
- Consent: for non-essential cookies such as analytics, where the law requires it. You can withdraw consent at any time.
- Legal obligation: where we must keep or disclose information by law
5. Who we share it with
We share personal information only as needed with:
- Service providers who help us run the Site and our business, such as website hosting, email, analytics and (in future) customer relationship management tools. They may only use your information to provide services to us.
- Our team, including project leads based in sub-Saharan Africa, where needed to respond to your enquiry
- Professional advisers such as lawyers and accountants, under confidentiality duties
- Authorities, where required by law or to protect our rights, users or others
- A successor business, if Yenda is involved in a merger, acquisition or sale of assets
6. International transfers
We're based in the United States, and our team works across several countries, including Zambia, Kenya, Malawi, South Africa, Zimbabwe, Botswana and Namibia. Your information may therefore be processed outside the country where you live. Where the law requires it, we use appropriate safeguards for these transfers, such as standard contractual clauses.
7. How long we keep it
We keep enquiry information for as long as needed to respond to you and manage any resulting relationship, and generally no longer than 24 months after our last contact, unless we need it longer for legal or contractual reasons. Analytics data is kept in line with our analytics provider's settings. Files you upload with an enquiry are deleted when they're no longer needed to assess your project, unless they become part of an agreed engagement.
8. Security
We use reasonable technical and organisational measures to protect personal information, including access controls, regular access reviews and confidentiality commitments from our team. No website or transmission over the internet is completely secure, so we can't guarantee absolute security.
9. Cookies and analytics
We use:
- Essential cookies, which the Site needs to work (for example, remembering your cookie choices)
- Analytics cookies from our analytics provider, which help us understand how visitors use the Site. They collect information such as pages viewed and time on site.
Where the law requires it, we'll ask for your consent before setting analytics cookies, and you can change your choice at any time through the “Cookie settings” link in the footer. You can also block or delete cookies in your browser settings. Blocking essential cookies may affect how the Site works.
10. Your rights
Depending on where you live, you may have the right to:
- access the personal information we hold about you
- correct inaccurate information
- delete your information
- object to or restrict certain processing
- receive your information in a portable format
- withdraw consent where we rely on it
EU and UK: you can also complain to your local data protection authority.
California: you have the right to know what personal information we collect and how it's used, to request deletion or correction, and not to be discriminated against for exercising your rights. We don't sell personal information or share it for cross-context behavioural advertising.
Africa: if you're in a country with data protection law, such as Kenya (Data Protection Act, 2019), South Africa (Protection of Personal Information Act, 2013) or Zambia (Data Protection Act, 2021), you have the rights those laws give you, including access, correction, objection and deletion, and the right to complain to the relevant regulator.
To make a request, email hello@inyenda.com. We may need to confirm your identity before acting, and we'll respond within the time the applicable law requires.
11. Links to other websites
The Site may link to other websites, such as client sites or research papers. We're not responsible for their privacy practices, so please read their policies.
12. Changes to this policy
We may update this policy from time to time. We'll post the new version here with a new “Last updated” date. If changes are significant, we'll make that clear on the Site.
